추방 유예 연장 신청

이민국은 지난 2월 19일자로 DACA 즉 추방 유예  신청자들의 추방 유예 연장 관련 GUIDLINE 을 발표하였습니다. 이번 NOTICE 는 다만 DACA 가 ice (Immigration and Customs Enforcement) 에 의하여 6월 15일부터 8월 15일 사이에 승인난 DACA 케이스에 한하여 해당된다는 조건이 있었습니다. I-821D 를 사용하여 추방 유예 신청을 하신 신청자들에게는 해당되지 않습니다

헌데 이번 NOTICE 에서 관심이 가는 대목은, 반드시 120일전부터 충분한 시간을 가지고 연장 신청을 하라는 안내입니다. 그 이유는 다음과 같습니다.

If your previous period of deferred action expires before you receive a renewal of deferred action under DACA, you will accrue unlawful presence and will not be authorized to work for any time between the periods of deferred action.  For this reason, USCIS encourages you to submit your request for renewal 120 days before your current period of deferred action under DACA expires.

만일 DACA 해택을 받은 신청자가 18세 이전의 신청자라면 반드시 DACA 연장을 서둘러서 반드시 추방 유예 기간이 유효한 상태로 연장을 승인 받는것이 중요하다 생각합니다.
